Terms of Service

These Terms of Service (“Terms”) govern your access to and use of MotorIQ, a cloud-based vehicle management and invoicing platform. MotorIQ is operated by its founders, Muhammed Umar Shaikh and Anas Shaikh, based in Pune, Maharashtra, India (“MotorIQ”, “we”, “us”). By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

You must be at least 18 years old to use MotorIQ. If you are using MotorIQ on behalf of a dealership or other business, you represent that you are authorised to bind that business to these Terms, and “you” refers to that business.

MotorIQ provides cloud-based tools for vehicle inventory, sales, invoicing, CRM, expenses and related dealership workflows. We may add, change, or remove features over time, and will give reasonable notice of material changes that significantly reduce core functionality.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Do not share credentials with anyone outside your dealership. Notify us promptly at [email protected] if you suspect any unauthorised use.

• Subscriptions are billed in advance on the plan and cycle shown at the time of purchase.
• Founding-member pricing, where offered, is locked for the lifetime of your continuous subscription.
• Fees are exclusive of taxes; applicable taxes (including GST, where charged) are added as required by law.
• Unless stated otherwise, fees are non-refundable, including for partial billing periods.
• You may cancel at any time and will retain access until the end of your current billing period.
• If payment is overdue, we may suspend or limit access after giving you reasonable notice.
• We may change pricing for future billing periods with prior notice; changes do not affect the period already paid for.

You own all the business data you enter into MotorIQ. We store and process it on your behalf to provide the service, as described in our Privacy Policy. You are responsible for the accuracy and lawfulness of the data you enter, including having the right to store information about your own customers. You can export or request deletion of your data as set out in the Privacy Policy.

You agree not to:

• Use MotorIQ for any unlawful, fraudulent or misleading purpose.
• Store false, forged or knowingly inaccurate vehicle or transaction records.
• Attempt to copy, decompile, reverse-engineer or resell the platform.
• Interfere with, overload, or attempt to gain unauthorised access to the platform or other tenants’ data.
• Upload malware or content that infringes the rights of others.

MotorIQ, including its software, design and content, is and remains our property. We grant you a limited, non-exclusive, non-transferable right to use the platform for your dealership during your subscription. These Terms do not transfer any ownership of the platform to you.

We work to keep MotorIQ available and reliable, but we do not guarantee uninterrupted or error-free operation. The service may occasionally be unavailable for maintenance, updates, or reasons beyond our control. Unless we have agreed a separate written service-level agreement with you, the service is provided without any uptime guarantee.

The service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. MotorIQ is a software tool: we are not responsible for the accuracy of GST, RTO or other filings you make based on data entered into the platform. You should verify tax and compliance calculations with a qualified professional.

To the maximum extent permitted by law, MotorIQ shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the service. Our total aggregate liability for any claim relating to the service is limited to the amount of subscription fees you actually paid to us in the three (3) months immediately preceding the event giving rise to the claim.

You agree to indemnify and hold MotorIQ harmless from any claims, losses, or expenses arising from your misuse of the service, your breach of these Terms, or your handling of customer or third-party data in violation of applicable law.

You may stop using the service and close your account at any time. We may suspend or terminate access if you breach these Terms, fail to pay fees, or use the service in a way that risks harm to others or to the platform. On termination, you may export your data for a reasonable period before it is deleted in line with our Privacy Policy.

We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Continued use of MotorIQ after an update means you accept the revised Terms.

These Terms are governed by the laws of India. Any dispute relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts at Pune, Maharashtra, India.
